Short Course: Law of the Sea

Course Outline
This course offers a comprehensive overview of the legal and regulatory framework governing the world's oceans and seas. Participants will learn how States establish their maritime boundaries and States' rights and obligations in the various maritime jurisdictional zones. They will also explore the rules and procedures for the peaceful resolution of international disputes and how courts and tribunals can contribute to good ocean governance. The course also covers the impact of climate change on the oceans, states' human rights obligations towards migrants rescued at sea, and the interplay between marine natural resource exploitation and environmental protection, within and beyond national jurisdiction.
Led by experts in law of the sea from both academia and practice, the course provides participants with a solid working knowledge of the main sources of the law of the sea, including treaties, customary law and judicial practice and how these elements are put to the test in different contexts, from protecting the marine environment and managing vulnerable species, to regulating deep-sea activities and, crucially, to peacefully resolving disputes between States. The course offers fresh practical perspectives by analysing real-life examples, current problems and challenges, and emerging developments in the field, such as the new High Seas (BBNJ) Treaty.

Course format
The virtual course format will consist of a series of 8 sessions in which live (synchronous) teaching is offered via Zoom. Participants will be able to interact with the tutors and amongst themselves on screen.
