What this event is about:
The relationship between intra-EU investment treaties and EU law continues to be a live issue. In a host of decided and on-going cases, investor-state arbitral tribunals have been called upon to address whether EU law forecloses claims by investors under intra-EU investment treaties. No consensus has yet emerged with a number of arbitral tribunals refusing to find that EU law prohibits such claims. What is the current state of play in the arbitral (and judicial) jurisprudence? What is the future of these kinds of claims?
