This ITF meeting will feature a debate of the scope, relationship and method for delineating between regulatory freedom and indirect expropriation and ways for resolving this in practice - considering important issues such as the intent and effects of State actions.
It will also include the launch of Dr Aniruddha Rajput's book entitled "Regulatory Freedom and Indirect Expropriation in Investment Arbitration." Published in 2019 by Wolters Kluwer, the book draws on a broad range of the jurisprudence of investment tribunals, as well as of other international courts and tribunals such as the International Court of Justice, the Permanent Court of International Justice, dispute resolution bodies of the World Trade Organization and the European Court of Human Rights.
The event will feature a debate on where to draw the line between (1) regulatory freedom for States and (2) protection for investors in the context of State measures the effect of which is the substantial deprivation of the value of the investors' investments.
A wine and canapé reception will follow the event.
