Meaning and Scope of the EU Rule of Law (Reconnect deliverable 7.2)

The Working Paper addresses the key questions surrounding the meaning and scope of the EU rule of law: primarily whether, and the extent to which, supranational understandings of the rule of law differ, if at all, from the national understandings. The paper also examines the European minimum standards of the rule of law, and whether the EU has promoted or applied different understandings for instrumental reasons. The paper concludes that the rule of law can and should be considered a core and consensual element of Europe's legal space.

While engaging with critiques of the rule of law can help engage and empower actors to consider its fundamental value and meaning, the paper submits that the most common critiques against the rule of law as a core, consensual value within the European legal space are ill-founded.
