This project undertakes an assessment of new specialist Commercial Courts. These might change the litigation landscape post Brexit by attracting litigation business that traditionally went to the English courts. It has been a recent trend to create such courts in various jurisdictions where cases can be dealt with in English and under English law/ by English judges (see eg the Singapore or Qatar Commercial Courts). The perspective of Brexit has led to similar court initiatives in some EU jurisdictions (notably Germany, the Netherlands, Belgium and France). The project looks at the frameworks within which these new courts operate. It also examines the potential impact of these courts on commercial arbitration.
