Product Liability Forum Published in the Modern Law Review

Research work undertaken by Duncan Fairgrieve and Geraint Howells on the recently-implemented General Product Safety Regulations has been published as a substantial article in the leading journal, the Modern Law Review ("General Product Safety: A Revolution through Reform?", (2006) 69 MLR 1).

In the article, the authors argue that the new product safety regime, implementing the European Directive 2001/95, fundamentally alters the requirements on businesses to respond to product safety concerns. Businesses have to inform regulators of problems. Regulators' powers have been revamped, including the controversial product recall provisions. From a broader perspective, this is illustrative of the delicate balance that exists concerning the extent and nature of European harmonisation of national norms.
