Impact of the International Law Commission's Articles on Responsibility of States for Internationall

A preliminary draft of the British Institute's research project on the 'Impact of the International Law Commission's Articles on Responsibility of States for Internationally Wrongful Acts' was completed in 2007 and is available here.

The aim of the study was to provide a comprehensive overview of instances of express reliance on the Articles in international judicial and arbitral practice, as well as by domestic courts, since the adoption of the Articles by the International Law Commission in 2001. Further, in addition to cataloguing instances of express reliance on the Articles, the study also extracts and discusses the most important pronouncements of international courts and tribunals in relation to the topic of State responsibility made without reference to the Articles. Support for the project was generously provided by the Foreign and Commonwealth Office and Lovells LLP.

This preliminary draft was made available for information and comment in advance of the debate on the Articles in the UN General Assembly in 2007.
