Join BIICL and Cooley for the launch of a landmark study on how technology‑sector regulation intersects with investment treaty protections. This study sheds light on the treatment of digital‑era regulatory measures through the lens of investment law and arbitral practice.

The study delineates what counts as a protected "investment" for tech businesses characterized by intangible assets and cross‑border footprints, analyses jurisdictional and territorial hurdles for platform‑based models, and links contested regulatory measures to core treaty standards drawing on treaty text and case law. It also develops case studies on certain regulatory measures affecting technology companies to illustrate how these measures may trigger treaty claims.

The event will bring together leading practitioners, academics, and policymakers to explore these findings, discuss emerging trends in technology‑related investor‑state disputes, and examine the broader implications for the development of technology disputes and investment treaty arbitration.
