Join BIICL and Baker Botts on 15 October 2025 at the Baker Botts offices in London for the launch of an innovative empirical study on the annulment of investor-state arbitration awards in domestic courts.
The evening event will bring together leading practitioners, academics, and policymakers to explore key findings, discuss trends in annulment proceedings, and examine the broader implications for international arbitration.
This study reviews 170 non-ICSID annulment proceedings across 16 jurisdictions and compares them with ICSID annulment practice. It shows that national courts annulled awards at a significantly higher rate than the success rate under ICSID's narrowly defined annulment grounds. It analyses the concentration of annulments in a handful of jurisdictions reflecting both their popularity as arbitral seats and the broader grounds available under national laws, particularly public policy and jurisdictional challenges.
While non-ICSID annulments are growing in number and increasingly successful, ICSID annulment remains an exceptional remedy with a consistently low rate of success and limited practical impact. The study identifies notable trends, including the growth in annulment applications, the increasing use of public policy objections, and divergent approaches to intra-EU law objections (accepted in Sweden and France, rejected in Switzerland and outside the EU).
