ITF Event: Sanctions-Related ISDS Disputes - Issues of Jurisdiction and Merits (Hybrid)
Event Details
In recent months, several investment treaty claims have been notified, and a few have already been initiated, based on measures taken in response to sanctions.
These disputes concern both Western sanctions against entities allegedly connected to the Russian government, and various countermeasures taken by the Russian government against entities from so-called "unfriendly jurisdictions".
With more such investment arbitrations expected to follow, this timely panel will address these developments, with a particular focus on the jurisdictional and merits issues expected to arise.

Introductory Remarks
Prof. Yarik Kryvoi is the Senior Fellow in International Economic Law and Director of the Investment Treaty Forum. He is also an Of Counsel at Keidan Harrison in London. Prof Kryvoi's expertise is primarily in the areas of international dispute resolution, including investor-state arbitration and international commercial arbitration, international administrative law and international public law.
In addition to his role at the BIICL, he is a visiting professor at a London-based university and a co-director of the Arbitration Lab. He has several years of experience practising international dispute resolution with Freshfields Bruckhaus Deringer in London, Morgan Lewis & Bockius in Washington, DC and Baker & McKenzie in Saint Petersburg.
Speakers
Dr. Joel Dahlquist acts as an advisor in international arbitrations arising under investment treaties and contracts. In particular Joel has experience representing sovereign states in investor-state arbitrations.
Prior to joining the firm, Joel worked as tribunal secretary to arbitral tribunals in more than twenty large-scale international arbitrations, governed by the ICSID, SCC, UNCITRAL, and ICC rules, as well as ad hoc. Before that, Joel worked as a full-time academic for six years, teaching public and private international law, as well as international commercial and investment arbitration, to both undergraduate and postgraduate students.
Joel has also worked at the Arbitration Institute at the Stockholm Chamber of Commerce and as a law clerk at Södertörn District Court in Stockholm. Joel maintains a keen interest in academia, and currently teaches international arbitration at the London School of Economics and Uppsala University, from where he also received his doctorate in public international law in 2019.
Damroka Koscielak is a member of the International and European Law Department at the Office of the General Counsel to the Republic of Poland (PGRP). Her practice includes investment treaty arbitration, international commercial arbitration and domestic litigation with a particular focus on mining, construction, infrastructure and energy disputes. She has acted for private and public entities in arbitral proceedings conducted under several arbitration rules (ICC, SCC, ICSID AF, DIAC and UNCITRAL).
Damroka is a Polish qualified attorney (Warsaw Bar Association). She holds a Master's Degree in Law from The University of Warsaw and an LL.M. in International Dispute Resolution from Queen Mary University of London.
Dr. Paschalis Paschalidis is Counsel in the Litigation and Dispute Resolution practice of Arendt & Medernach. He acts as counsel in commercial and investment treaty arbitrations under a variety of arbitral rules. He also acts before the courts of EU Member States and the Court of Justice of the European Union, notably in proceedings regarding the enforcement or annulment of arbitral awards.
Paschalis is included in the European Commission's List of Candidates suitable for Appointment as Arbitrators and teaches a course in international investment arbitration at the University of Lyon 3 'Jean Moulin'. In the past, he served as référendaire for First Advocate General Melchior Wathelet at the Court of Justice of the European Union. Paschalis holds a Doctorate in Philosophy in Law from the University of Oxford.
Oonagh Sands is a dually-qualified English and US lawyer: she is an English-qualified Solicitor and Solicitor-Advocate (Higher Courts Civil Proceedings), as well as an Attorney in New York State and the District of Columbia. She has deep experience representing sovereign States and State-owned entities, as well as individuals and private entities, before leading world dispute resolution fora.
Oonagh has represented clients before the International Court of Justice, the Permanent Court of Arbitration, as well as investor-State arbitral tribunals constituted under ICSID, ICSID Additional Facility, UNCITRAL, SCC and ICC Rules. She regularly counsels clients on international dispute resolution, the law of State responsibility, and treaty interpretation, among other areas of public international law. The Legal 500 recognises Oonagh as a "Rising Star" in public international law.
