Event Details

This hybrid workshop is another East-meets-West initiative. Co-organised by UK's Queen Mary Intellectual Property Research Institute (QMIPRI), British Institute of International and Comparative Law (BIICL), China's Chongqing University of Technology, and South Korea's Moonsoul Graduate School of Future Strategy (GFS) and Korea Advanced Institute of Science and Technology (KAIST), the hybrid workshop aims to explore the criminal sanctions in the regime of intellectual property (IP), including the legislation and enforcement. It provides a platform for legal scholars, researchers, and practitioners from different legal systems to share their insights on the topic and to review the challenges and opportunities presented by emerging technologies in this field. It consists of three panels, each of which examines a key aspect of IP criminal sanctions.

"The Criteria of Criminal Sanctions in IP" focuses on the factors determining the confirmation of criminal sanctions in IP cases. The panel discusses the different criteria that have been applied by courts in various jurisdictions, their appropriation and the pros and cons.

"Enforcement and Compliance: An Interpretation of Criminal Sanctions" examines the relationship between criminal sanctions and administrative enforcement, and the role of criminal sanctions in promoting compliance in the context of IP. The panel explores the diverse approaches taken by individual jurisdictions in this regard and considers the benefits and drawbacks of each approach.

"The New Technology and Criminal Sanctions in IP" will weigh the challenges posed by new technologies in the context of criminal sanctions in the IP regime. The panel looks into the impact of emerging technologies, such as AI, web crawling and Metaverse, on IP enforcement, and assesses the implications in IP criminal sanctions particularly.
