It is now rare to find an investment dispute which does not include a claim of a breach of legitimate expectations. Such claims have been successful in a wide variety of circumstances leading to concerns from some that the doctrine has lost its moorings. This debate considers whether tribunals are losing control of the doctrine of legitimate expectations, or if the doctrine is finding its proper place in the ISDS regime.
