Merricks v MasterCard: Collective Actions Reinvigorated

Event Details

Time: 12.30-13.45
(Registration and sandwich lunch from 12 noon)

Venue: British Institute of International and Comparative Law, Charles Clore House, 17 Russell Square, London WC1B 5JP

The England and Wales Court of Appeal has overturned the Competition Appeals Tribunal's decision in the collective proceedings Merricks v MasterCard. The decision ensures that financial damages are recoverable when a firm's anti-competitive practices affect millions of consumers, which makes this decision so important. While the judgment does not solve all of the problems with the collective proceedings regime, it can be expected to breathe new life into a regime, which has yet to prove its worth in practice. The judgment will be discussed by an excellent line of speakers.

Chair

Dr Liza Lovdahl-Gormsen, British Institute of International and Comparative Law

  • Professor Rachael Mulheron, Queen Mary University of London
  • Noel Dilworth, Henderson Chambers
  • Tristan Jones, Blackstone Chambers
