EVENT PAPERS

70 Years of the International Court of Justice

Download The Kosovo Question event paper by Ben Juratowitch (Freshfields Bruckhaus Deringer).

This special event celebrated the 70th anniversary of the International Court of Justice, which began its operation in 1946. The event focused on the advisory function of the Court in order to assess how it balances its dual role as an organ of the UN and a judicial body.

Speakers discussed, among others, Legal Consequences for States of the Continued Presence of South Africa in Namibia (South West Africa) notwithstanding Security Council Resolution 276 (1970), Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory (2004), and Accordance With International Law of the Unilateral Declaration of Independence in Respect of Kosovo (2010).

The discussion covered the Court's approach to politically contentious requests for advisory opinions, the role of advisory opinions in dispute settlement, and whether requests for advisory opinions invite the Court to be more than a judicial body.
