The National, EU and International Law Regulation of Biofuels - Critical Issues for Energy Security,

The direct regulation of biofuels in the European Union is now governed by the 2009 Renewable Energy Sources Directive which came into force in June 2009. It establishes a 10% binding target for renewable use in transport by 2020.

The talk examines the following issues

- Does the new regime achieve its stated objectives of energy security in the transport sector and climate change mitigation?
- Does the new regime provide sufficient legal certainty to the investment community (a purported aim of the binding nature of the 10% target)
- The Directive also establishes the world's first system of environmental sustainability certification for biofuels. Are these sustainability criteria in breach of the EU's international obligations (in particular under WTO law)?
