European Law Seminar Series: The European Evidence Warrant

The proposed European Evidence Warrant will extend the principle of mutual recognition of judicial systems in the EU. The removal of borders within the EU, and the increase in international terrorism has increased the need for effective cross-border law enforcement, in part tackled by the Arrest Warrant, but needing practical support in the form of an accelerated procedure for the transfer of evidence needed for criminal prosecutions between states. Critics have accused the proposal of going too far, but also not going far enough, and human rights campaigners have said it will undermine the balance of national security and civil liberties in the Member States. The discussion will focus on the future of this proposal and its parameters.
