In 2005 the Bundesverfassungsgericht declared the European Arrest Warrant unconstitutional because it did not respect fundamental rights and procedural guarantees. The Commission stressed it was the German implementing law that was at fault and not the EU framework decision, and has hailed it as one of the successes of EU anti-terrorism policy. However, the arrest warrant no longer applies in Germany, and the suspect in the case has been released. It will take a new law from the German Parliament to reinstate the arrest warrant. This situation has prompted the need for examination of the limits of competence in this area as well as the potential impact upon domestic practice.
