Obligations of States in Undelimited Maritime Areas

Consisting of two panels featuring experts in Law of the Sea and members of the BIICL research project on the obligations of States in undelimited maritime areas, this event will analyse and discuss the obligations of States in regard to undelimited areas pending agreement on maritime boundary delimitation. In particular, the event will focus on the obligations of States under Articles 74(3) and 83(3) of UNCLOS to refrain from activities that could jeopardise or hamper the reaching of a final agreement on maritime delimitation.

The panels will present the findings of the BIICL research team and the implications of the research in practice. This will include a discussion of the impact of the decision of the ITLOS Special Chamber on provisional measures in the Dispute Concerning Delimitation of the Maritime Boundary between Ghana and Côte d'Ivoire in the Atlantic Ocean as well as relevant aspects of the Award on the Merits of the Annex VII Arbitral Tribunal in The Republic of Philippines v The People's Republic of China case (released 12 July 2016).

The event will be of interest to international law practitioners, government officials, offshore oil and gas industry specialists and academics. Copies of the BIICL publication "Report on the Obligations of States under Articles 74(3) and 83(3) of UNCLOS in respect of Undelimited Maritime Areas" will be distributed at the event. 11:15-12:45pm: Panel 1: "Legal issues arising from Articles 74(3) and 83(3) of UNCLOS"

This panel will discuss the legal issues raised by the obligations set out in Articles 74(3) and 83(3) of UNCLOS not to jeopardise or hamper the reaching of final maritime delimitation agreement, as addressed by the BIICL research team in their report. The panel will also highlight outstanding questions such as State's obligations in undelimited maritime areas involving sovereignty disputes

1:30-2:30pm: Panel 2 "Practical implications of Articles 74(3) and 83(3)"

This panel will examine how issues involving Articles 74(3) and 83(3) arise for States and private entities in practice. The panel will also discuss relevant aspects of the merits award in the Philippines v China arbitration.

Cancellation by us

The British Institute of International and Comparative Law reserves the right to modify or cancel any event if unforeseen circumstances arise. If we cancel an event we shall inform you as soon as possible using the contact details provided to us and offer you a full refund.

Cancellation by you

All cancellations must be made in writing via email to eventsregistration@biicl.org and be no less than one week prior to the event.

Payment for registration will always be required, and must be made prior to the event. If sufficient written notification of cancellation is received, a full refund will be given. If insufficient notice is given, payment for your registration will still be required.

No charge events

All events are costly to set up, even those for which there is 'no charge'. If you register but find you are unable to attend, please let us know as soon as possible. As a charity we need to cover the costs of events, and we may charge you a fee of £10 for administration and catering costs if you fail to attend or give us less than 24 hours' notice.
