Dispute Resolution in the Telecommunications Sector

In 2004 the Institute undertook a research project on the effectiveness of dispute resolution in the telecommunications sector. The outcome of this project is a study which assesses the law and regulatory practice in selected EU member states. The interaction of the domestic legal systems with the European framework legislation for telecommunications and Internal Market rules is a major focus of the study. The core question is the extent to which national procedural rules and dispute resolution mechanisms impact on the availability and effectiveness of the underlying substantive telecommunications rules and, ultimately, the creation of a single European telecommunications market. Such institutional issues are often neglected.

As part of this initiative workshop entitled Dispute Resolution in the Telecommunications Sector: Reforming National Legal Systems in the Light of the New Regulatory Framework was held on 30 October 2003. This brought together leading academics, practitioners and regulators and constituted an important contribution to the discussion of strengths and weaknesses of national regulatory regimes and the current implementation process of the European New Regulatory Framework.
