State Immunity in State Practice

The study on State Immunity in State Practice is undertaken by the Institute in 2004, in collaboration with Professor Gerhard Hafner, Vienna, and Professor Marcelo Kohen, Geneva. Several members of the Institute is involved, including Lady Fox, Mads Andenas and Susan Breau. This was a project funded by the Council of Europe. The study is based on information gathered from a questionnaire, adopted by the Committee of Legal Advisers on Public International Law (CADHI) of the Council of Europe, and sent to the Member States of the Council of Europe and the Observer States.

The Institute has an extensive programme on state immunity issues, both with focus on public international law, and also on the European Convention on Human Rights and domestic law and exploring the relationship between these different legal orders.

In 2006 the work was published by the Council of Europe in State Practice Regarding State Immunities.
