First of the Arthur Watts Public International Law Seminar Series

Litigation of claims related to international matters affecting the United Kingdom has increased significantly in recent years. Public international law issues are being raised in novel and controversial ways as claimants push at the boundaries of the established extent of jurisdiction of the courts in the UK. This seminar will address recent developments, identify current trends and discuss future challenges and opportunities for private litigants, the Government and the courts.

Sam Wordsworth will look at the issues currently arising in the application of customary international law in the English courts, and the latest pronouncements on act of state and non-justiciability.

Professor Warbrick will look at the national constitutional context in which decisions in the field of foreign relations are taken, in particular, the relations between the executive and the courts; the inquiry by the International Law Commission into the role of national courts in the process of customary international law; and the certification power in foreign affairs, examining recent practice and cases to see how the power has an impact on private rights.

Stephen Fietta will comment upon the issues raised by the first two speakers.

The seminar will be followed by a drinks reception.
