The Application of the Brussels I Regulation in England & Wales

The Institute has contributed to a Study commissioned by the European Commission on the application of the Regulation 44/2001/EC (the 'Brussels I Regulation') on jurisdiction and the recognition and enforcement of judgment in civil and commercial matters in the 25 EU Member States. The Commission is to report later in 2006 on the functioning of the Regulation (in accordance with Article 73 of the Regulation) to the European Parliament, the Council and the Economic and Social Committee.

The overall study, which comprises 25 national reports, has been coordinated by the Institute for Private International Law in Heidelberg. It is intended to result in a report for the Commission on the application and future improvement of the Regulation. The specific objective of the study is to conduct an empirical analysis of the application of the Regulation to date.

For the purpose of drafting its report the British Institute used three detailed questionnaires. The first questionnaire aimed at collecting statistical data about the application of the Regulation. The second focused on collecting empirical information about the performance of the Brussels I Regulation. The last questionnaire addressed legal problems in the application the Regulation.
